These terms apply to sip & play, an independently operated service based in Virginia, United States. By creating an account or submitting a game entry or guest-book note, you agree to these terms. If you do not agree, do not submit content or create an account.
Using the service
sip & play provides event trivia, leaderboards, and optional guest books. Hosting and playing are currently free, subject to usage limits. The service is for entertainment, not gambling or official competitions. Hosts are responsible for any prizes or promotions they independently offer and for complying with the rules that apply to them.
You must be at least 18, or the age of legal majority where you live if higher, to create a host account. Guests must be at least 13 and have permission from a parent or guardian if required by local law. Keep your account secure and use only accounts you are authorized to access.
Your content and responsibilities
You keep ownership of content you submit. You give us a nonexclusive, worldwide, royalty-free permission to store, process, display, and transmit that content only as needed to operate, secure, and support the service, including presenting event content and delivering guest-book notes and exports to hosts. This permission lasts while the content is retained for those purposes; it does not give us ownership or permission to use private notes in advertising.
Only submit content you have the right to share. Hosts are responsible for their event questions, personal information they include about others, how they distribute event links, and their use of guest data and exports. Guest-book contributors understand that the host can keep and share their notes outside the app.
Do not submit unlawful, threatening, harassing, discriminatory, sexually exploitative, or infringing content; impersonate others; publish confidential information without permission; send spam; or attempt to bypass security, usage limits, or access controls. Do not interfere with the service or access another person's account or private records.
Event access and privacy
Published events are accessible to anyone with their link. Leaderboard names and scores are visible to people who access that leaderboard. Guest-book notes are available to the host and authorized service operators as described in our Privacy Policy. An unlisted link is not a guarantee of confidentiality.
Use a nickname if you prefer. Do not submit sensitive information that is unnecessary for the event. Hosts should obtain any permissions or provide any notices required for their collection and use of guest information.
Availability and keeping your memories
We aim to keep the service useful and available, but cannot promise uninterrupted access, compatibility with every device, error-free scoring, or permanent storage. Connectivity, browser storage, third-party services, maintenance, and outages can affect play.
Export any guest-book content you want to keep. Retention rules and deletion choices are described in our Privacy Policy and event management. We may change features or limits, or discontinue the service. Where reasonably practicable, we will give advance notice of changes that materially affect existing events or access to stored content.
Moderation and ending access
You can report an event from its guest page. We may investigate reports, remove content, restrict accounts, or suspend access when reasonably necessary to address abuse, security risks, legal requirements, or violations of these terms. We may act without advance notice where urgency or law requires it.
Hosts can delete events or their accounts through management. Deletion does not remove copies already exported by others or records we must lawfully retain.
Disclaimers and limits
To the extent permitted by applicable law, the service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that events, scores, or user-submitted content will be accurate or meet your expectations.
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses arising from use of the service, including lost profits, interrupted events, or lost data. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, willful misconduct, gross negligence, or death or personal injury. Your mandatory consumer rights remain unaffected.
Changes to these terms
We may revise these terms and will update the date above. We will provide notice of material changes and request renewed agreement where required. Changes will not retroactively take away rights that have already arisen. If you do not accept revised terms, stop submitting content and use the available export and deletion options.
If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms do not impose mandatory arbitration or waive rights you have under applicable law.
